General Terms and Conditions of Region Villach Tourismus GmbH

1 SCOPE OF APPLICATION:
These General Terms and Conditions apply in principle to all bookings made via Region Villach Tourismus GmbH and for which Region Villach Tourismus GmbH acts as an agent or organizer. Specifically, these General Terms and Conditions apply to bookings made via the homepages of Region Villach Tourismus GmbH, as well as to bookings made in writing, by fax or verbally / by telephone via Region Villach Tourismus GmbH. By making a booking, the contractual partner / guest accepts these General Terms and Conditions and they therefore become part of the contract.

2 CONTRACTUAL RELATIONSHIP BETWEEN REGION VILLACH TOURISMUS GMBH AND THE GUEST:

2.1 REGION VILLACH TOURISMUS GMBH AS INTERMEDIARY:
Region Villach Tourismus GmbH offers the guest the opportunity to book travel or third-party services directly via Region Villach Tourismus GmbH as an intermediary. Region Villach Tourismus GmbH itself does not offer any travel or services under its own responsibility as part of its intermediary activity and therefore assumes no liability for the booked travel or service. The booking merely results in an agency agreement between the guest and Region Villach Tourismus GmbH, to which the provisions of § 31b ff KSchG do not apply. Region Villach Tourismus GmbH therefore does not owe the guest a (travel) service within the scope of its mediation, nor does it guarantee contractual fulfillment by the accommodation provider. However, Region Villach Tourismus GmbH owes its diligent efforts to provide the guest with the services of a third party (organizer, transport company, hotelier, etc.), whereby any possible liability of Region Villach Tourismus GmbH for this mediation activity is limited to cases of intent and gross negligence. Invoicing and settlement of the arranged service shall always be carried out directly by the accommodation establishment and the General Terms and Conditions of the Austrian Hotel Industry 2006 shall apply to the arranged services themselves, insofar as this establishment is a member of the Austrian Hotel Industry.

2.2 REGION VILLACH TOURISMUS GMBH AS ORGANIZER:
In exceptional cases, Region Villach Tourismus GmbH acts as the organizer, whereby the organizer status of Region Villach Tourismus GmbH is expressly referred to in the context of these (exclusively package) offers. In these cases, Region Villach Tourismus GmbH is liable as the organizer for the (own) service offered, whereby possible compensation for damages is also

3 BOOKING
3.1 BOOKING OF ARRANGED SERVICES:
In the case of brokered services, reservations are passed on to the relevant establishment via Region Villach Tourismus GmbH as an agent on behalf of the guest as part of a brokerage contract. This agency service by Region Villach Tourismus GmbH is free of charge for the guest.

3.2 REGION VILLACH TOURISMUS GMBH AS THE ORGANIZER:
In the case of travel offers (packages) provided by Region Villach Tourismus GmbH as the organizer (and clearly marked as such in the text of the offer), the guest makes his/her reservation directly with Region Villach Tourismus GmbH as the organizer. In the case of mediated services as well as own events, the booking / reservation request is made either by the guest making an entry on the booking platform or by other written or verbal declaration by the guest to Region Villach Tourismus GmbH.

4 CONCLUSION OF THE CONTRACT:
The intended contract (accommodation, hotel service, travel service) is only concluded upon confirmation of the booking by Region Villach Tourismus GmbH, whereby the intended contract is concluded exclusively with the accommodation provider in the case of arranged services and with Region Villach Tourismus GmbH in the case of events. The AGB of the Austrian Hotel Industry 2006 therefore apply to the arranged services themselves due to the direct contract with the accommodation establishment, unless the establishment has deposited its own AGB. If Region Villach Tourismus GmbH itself acts as an organizer, the intended contractual relationship arises directly between Region Villach Tourismus GmbH and the guest and in this respect these General Terms and Conditions and, in addition to these, the General Terms and Conditions 1992 of the Austrian Travel Agencies shall apply. The place of performance is the registered office of Region Villach Tourismus GmbH or the registered office of the booked accommodation establishment.

5 PAYMENT:
As soon as the contract has been concluded by confirmation, the following
payment terms apply:

5.1 FOR BROKERED CONTRACTS:
Payments for brokered contracts shall be made exclusively to the respective
accommodation provider in accordance with its terms and conditions. The accommodation provider has the right to demand a deposit as security. If it makes use of this right, a corresponding note shall be included in the offer and/or in the booking. The remaining travel price, as well as any additional costs incurred (final cleaning, local tax, electricity, etc.) must also be paid by the guest directly to the accommodation provider. If a credit card number is provided at the time of booking, the accommodation provider can use it in the event of a cancellation and debit the amount due. Region Villach Tourismus GmbH is not responsible for the content or the specific form of the contract concluded between the guest and the accommodation provider (e.g. cancellation fees, additional costs, etc.) and assumes no liability in this regard. The accommodation provider is solely responsible for the accuracy and up-to-dateness of the service provided and the availability of the rooms.

5.2 FOR OWN EVENTS/PACKAGES:
If Region Villach Tourismus GmbH acts as the organizer in its own name, the travel price and / or any required deposit must be paid directly to Region Villach Tourismus GmbH, whereby the respective payment amount and the specific payment and cancellation conditions are already specified.

6 CANCELLATION BY THE GUEST:
Notifications by the guest regarding changes and cancellations can be made to Region Villach Tourismus GmbH as well as directly to the accommodation provider for arranged services. However, the actual cancellation can only be made by Region Villach Tourismus GmbH.
For services organized by Region Villach Tourismus GmbH itself, changes or cancellations must be made exclusively to Region Villach Tourismus GmbH. The participating accommodation establishments have their own cancellation conditions, which the guest is informed of at the time of booking. If no such conditions are specified, the cancellation conditions of the General Terms and Conditions of the Austrian Hotel Industry 2006 shall apply.

7 HOTEL CATEGORIES AND HOTEL INFORMATION:

7.1 HOTEL CLASSIFICATION
The hotel classification is based on an inspection of the accommodation by the Austrian Hotel Association of the Austrian Federal Economic Chamber.

7.2 ADDITIONAL HOTEL INFORMATION
The additional hotel information is based on the hotel's own information. Region Villach Tourismus GmbH accepts no liability for this information.

8 DATA PROTECTION
The guest acknowledges that the personal data entered by him will be processed electronically for the purpose of fulfilling the intended contract. They will only be passed on insofar as this is necessary for the execution of the booking. It will not be passed on for any other purpose. Region Villach Tourismus GmbH complies with the statutory data protection regulations. Further information on the

9 PLACE OF JURISDICTION:
Austrian law shall apply to any legal disputes; the place of jurisdiction is Klagenfurt Regional Court.

10 INFORMATION ON PACKAGES:
Organizer: Region Villach Tourismus GmbH, GISA number 10902912 in the organizer directory of the Federal Ministry of Science, Research and Economy. In accordance with the Travel Agency Insurance Ordinance (RSV), customer monies for package tours offered by the
Region Villach Tourismus GmbH are covered under the following conditions: The deposit is paid at the earliest eleven months before the agreed end of the trip and amounts to 30% of the travel price. The remaining payment shall be made at the earliest 20 days before the start of the trip - step by step against delivery of the travel documents to the traveler. No further or premature down payments or final payments may be demanded. Deposits or remaining payments are only secured to the extent that the tour operator is entitled to accept them. The sum insured shall be used primarily to satisfy payments received in accordance with the regulations. Insurer: Bank guarantee with Raiffeisenbank Landskron/Gegendtal.

Villach Region Tourismus GmbH endeavors to provide you with a variety of offers and provides as much access as possible to the current range of services. A direct contract is only concluded with the autonomous, independently operating, commercial program organizers as local providers and service providers. The following terms and conditions are expressly agreed for the issue and use of the Experience CARD (hereinafter referred to as "CARD"):

1 CONDITIONS OF ISSUE FOR THE CARD:
All persons staying overnight in an accommodation establishment or on a campsite in the Villach - Faaker See - Ossiacher See region will receive the Erlebnis CARD exclusively from their respective host for the duration of their stay (including arrival and departure days). Only guests who are properly registered in accordance with the Registration Act and the Carinthian Local and Overnight Accommodation Tax Act and who are staying in the following municipalities are entitled to the card: Afritz am See, Arnoldstein, Arriach, Bad Bleiberg, Bodensdorf am Ossiacher See, Finkenstein am Faaker See, Nötsch im Gailtal, Ossiach, Paternion, Treffen am Ossiacher See, Villach, Weissenstein and Wernberg.
All legitimate holders of the CARD have the opportunity to book and use the services offered on https://card.visitvillach.at. Experience CARDS are not issued for persons not subject to local taxes, with the exception of people with a disability of over 50% and their accompanying person.

The CARD seasons are displayed on https://card.visitvillach.at. Locals and guests of other Carinthian tourism regions can book designated activities of the program for a fee.
Any additional costs for participation in activities are to be borne by the guest and are specially marked in the program.

2 SCOPE OF SERVICES:
All program organizers listed in the brochure are independently and commercially active (hereinafter referred to as "program organizers") and have undertaken to offer the holders of the CARD, taking into account and in accordance with their general terms and conditions, the following services

In order to ensure a fair distribution of places, all Erlebnis CARD holders are responsible for notifying Region Villach Tourismus GmbH via the Card Hotline (+43 664 1334146) or via the Erlebnis CARD Shop in the event of a necessary cancellation. Cancellation free of charge is possible until 16:00 the day before. Cancellation of individual program items by Region Villach Tourismus GmbH due to weather conditions or failure to reach the minimum number of participants is possible. In this case, you will be notified and any ticket price will be refunded.

4 NON-TRANSFERABILITY, DAMAGE AND LOSS:
The CARD is non-transferable and only valid in conjunction with a photo ID.

5 USE:
In order to obtain the services, the cardholder must present his/her CARD to the program organizer. The CARD will be checked for validity and identity by the Program Operator by means of an acceptance device or by mere visual inspection. The cardholder is obliged to present a valid photo ID upon request, otherwise he/she may be denied free use of the

6 ABUSE:

The issue of the CARD and the associated possibility of using programs in the region, which are organized by independent, self-responsible

8 PLACE OF JURISDICTION:

Personal data (first name, surname, title, date of birth), period of stay and accommodation name are processed for the purpose of using and issuing the CARD. This data is passed on by the respective accommodation, with the consent of the guest, to Region Villach Tourismus GmbH for central processing and administration,

6 CANCELLATION CONDITIONS:

Some program items can only be booked by holders of an Erlebnis CARD (guest card of the vacation region). Please note the information on the respective experience.

2 CONCLUSION OF CONTRACT: a) The presentation of tickets in the Experience Shop does not constitute a legally binding contractual offer, but is merely a non-binding invitation to the consumer to purchase tickets. By booking the desired event, the consumer submits a binding offer to conclude a purchase contract.

b) By clicking on the "Order with obligation to pay" button, the buyer submits a binding purchase offer. Immediately before submitting this order, the buyer can check the order again and correct it if necessary.

3) Region Villach Tourismus GmbH confirms receipt of the order immediately by means of an automatically generated e-mail ("order confirmation"). With this, Region Villach Tourismus GmbH accepts the offer. For security reasons, it is not possible to view the order data at a later date.

3 PRICES: The prices quoted include statutory VAT and other price components. In addition, there may be shipping costs, which are listed in the payment overview and included in the total price to be paid.
4 PAYMENT TERMS: a) Possible payment methods for the consumer:

5 DELIVERY, RESERVATION OF PROPERTY: Unless otherwise stated in the product description, all items offered are ready for immediate dispatch. Shipment usually takes place on the next working day.
